Terms and Conditions

Welcome to PWD Distributing. These terms and conditions outline the rules and regulations for the use of PWD Distributing's Website. By accessing this website we assume you accept these terms and conditions. Do not continue to use PWD Distributing if you do not agree to take all of the terms and conditions stated on this page.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: 'Client', 'You' and 'Your' refers to you, the person log on this website and compliant to the Company's terms and conditions. 'The Company', 'Ourselves', 'We', 'Our' and 'Us', refers to our Company.

Payment Authorization and Chargeback Policy

By clicking the emailed payment link and completing payment for a custom order, the customer confirms and agrees that:

The order and charge were placed voluntarily.
The customer personally authorized the transaction.
The customer is the authorized cardholder or has permission from the authorized cardholder to use the selected payment method.
The customer accepts responsibility for the full amount charged.
The charge will appear on the customer’s bank or credit card statement as PWD DISTRIBUTING LLC.
The single item labeled “Custom Order” represents the complete customized order agreed upon between the customer and PWD Distributing LLC.

Customers should contact PWD Distributing LLC directly if they have any questions or concerns regarding an order or charge before submitting a payment dispute.

Knowingly making a false claim that an authorized purchase was unauthorized—sometimes called “friendly fraud”—may constitute fraud or other criminal activity. PWD Distributing LLC reserves the right to contest fraudulent disputes using payment records, customer communications, order details, tracking information, proof of delivery, and other available evidence, and may report suspected fraud to the payment processor, financial institutions, or appropriate authorities.

Email Communications and Electronic Records

By submitting or paying for a custom order through an emailed payment link, the customer agrees that emails and other electronic communications exchanged with PWD Distributing LLC may be retained and used as transaction records. These records may document the customer’s order instructions, requested products, pricing, payment authorization, modifications, approvals, shipping information, and acceptance of the applicable Terms of Service.

To the fullest extent permitted by law, the customer agrees that electronic communications, confirmations, and records will have the same validity and evidentiary effect as comparable paper records. Federal law generally provides that contracts and records cannot be denied legal effect solely because they are electronic. 15 U.S.C. § 7001

Customers are responsible for providing and maintaining a valid, accurate, and accessible email address throughout the ordering and delivery process. Email is the primary method used to provide payment links, order confirmations, service communications, shipping updates, and other transaction-related notices. PWD Distributing LLC is not responsible for delays caused by an incorrect, inactive, inaccessible, or outdated email address supplied by the customer.

Order Fulfillment and Shipping

All physical product orders are fulfilled and shipped by our authorized third-party fulfillment partner, Sub-Zero Distributing LLC. Customers may receive shipping confirmations, tracking information, delivery notifications, or other communications directly from Sub-Zero Distributing LLC.

Once an order has been transferred to the fulfillment provider, Sub-Zero Distributing LLC is responsible for its preparation, shipment, tracking, and delivery. To the fullest extent permitted by law, PWD Distributing LLC is not responsible for carrier delays, lost or stolen packages, delivery to an incorrect address supplied by the customer, incorrect items, or other shipping- and delivery-related issues.

All shipping concerns must be reported directly to Sub-Zero Distributing LLC. Products received damaged or incorrect must be reported within 48 hours of delivery. Customers should retain all packaging and provide their order number, tracking information, and clear photographs of the package and affected items.

Customers are responsible for providing a complete and accurate shipping address. PWD Distributing LLC and Sub-Zero Distributing LLC are not responsible for delays, losses, or additional costs resulting from inaccurate or incomplete information supplied by the customer.

Shipping Schedule and Estimated Delivery Times

Orders are not processed, fulfilled, or shipped on federal holidays or on any day the United States Postal Service is closed. Orders scheduled for shipment on one of these dates will be shipped on the next available business day.

To qualify for next-day shipment, an order must be placed and paid in full before 5:00 p.m. Eastern Time (ET). Orders placed or paid after 5:00 p.m. ET will be processed for shipment on the following available business day.

Orders placed or paid on Saturday or Sunday will generally be shipped on the following Monday or Tuesday because our authorized third-party fulfillment provider, Sub-Zero Distributing LLC, is closed on weekends. If Monday or Tuesday is a federal holiday or postal closure date, the order will be shipped on the next available business day.

All processing, shipment, and delivery timeframes are estimates only and are not guaranteed. “Next-day shipment” means that the order is expected to be transferred to the shipping carrier on the next available business day; it does not guarantee next-day delivery. Carrier delays and circumstances outside the fulfillment provider’s control may affect the delivery date.

Product Quality and Custom Formulations

PWD Distributing LLC works with independent third-party sauce manufacturers to produce sauces for retail, wholesale, and custom orders. PWD Distributing LLC serves as an intermediary by communicating the customer’s requested ingredients, flavor profile, heat level, and other specifications to the selected manufacturer. The third-party manufacturer is responsible for producing and packaging the sauce.

Customers are responsible for reviewing and approving their custom sauce specifications. Because each custom sauce is based on the customer’s individual selections, personal dissatisfaction with the flavor, heat level, texture, color, or other subjective qualities of a sauce does not, by itself, make the product defective or qualify the order for a refund.

PWD Distributing LLC’s proprietary products, including Death By Sauce and other PWD-branded sauces, are also produced by independent third-party manufacturers according to the flavor and heat profiles requested by PWD Distributing LLC.

Any concern involving contamination, damaged packaging, a manufacturing defect, or a product that materially differs from the approved order specifications must be reported promptly. Customers should provide their order number, photographs, and a detailed description of the concern. Claims will be reviewed with the applicable manufacturer.

To the fullest extent permitted by law, PWD Distributing LLC is not responsible for manufacturing-related defects or inconsistencies caused by an independent third-party manufacturer. Nothing in this section limits any consumer rights, warranties, or remedies that cannot legally be waived.

Custom Sauce Orders and Pricing

Pricing for custom sauce orders is determined at the discretion of PWD Distributing LLC and is provided on a case-by-case basis. Creating a custom sauce may require us to design and formulate the requested heat level, flavor profile, and other product specifications before submitting the formulation to our partnered manufacturers for testing and sampling.

The final price may vary depending on the complexity of the requested formulation, desired heat level, ingredients, testing requirements, packaging, and order quantity. Additional development or sampling fees may apply if revisions or further testing are requested.

Unlike the individual bottles of PWD Distributing LLC’s in-house sauces sold on our website at listed prices, custom sauce orders do not have fixed or guaranteed pricing. Customers will receive and approve the applicable price before completing payment through the emailed custom-order payment link.
